CLAIM
about non-payment of winnings of 10'266'400 UAH.
on the website of BC Parimatch

As part of the pre-trial proceedings, and in response to repeated requests from support@parimatch.com to provide more detailed information about the winnings that have disappeared from my account, I would like to report the following:
1. Within the framework of the adopted Law of Ukraine No. 2285-d "On state regulation of activities on the organization and conduct of gambling", Parimatch LLC was one of the first to receive the necessary permits from the Commission for the Regulation of Gambling and Lotteries (KRAIL) for the organization and conduct of bookmaking activities, as well as gambling on the Internet for Ukrainian citizens:

“About the issuance of a license to a PARTNERSHIP WITH THE EXCHANGE OF VIDENTALITY “PARIMATCH” to carry out activities in the organization and conduct of bookmaking activities.”
RESOLUTION No. 48 dated 02/10/2021
“About the granting of a license to a PARTNERSHIP WITH THE EXCHANGE OF VIDENTALITY “PARIMATCH” to carry out activities in the organization and conduct of gambling casino games on the Internet.”
2. The relations between players and BC Parimatch are regulated by the Law of Ukraine "On state regulation of activities related to the organization and conduct of gambling" and the public Rules of the organizer, published on the parimatch website. Within the framework of this claim, the following points of the Rules are relevant:
Item 32 Communication failures or other technical failures in the client's communications are not a reason for cancelling a bet if the bet is registered on the server.
Item 46 Claims on controversial issues are accepted on the basis of an email application (to support@parimatch.com) within 10 days from the date of summing up the results for the relevant bet. After this period, no claims will be accepted.
p. 51 The maximum payout per bet is equal to the equivalent of $1,000,000 in the game account currency.
Item 79 In case of suspicion of fraud (multi-accounting, use of any software for automated betting, playing on arbitrage situations if the gaming account is not used to place bets and other products offered by the bookmaker network, abuse of loyalty programs, etc.), the bookmaker network has the right to suspend operations and/or payment of funds on the gaming account for the duration of the verification of gaming activity until its completion.
Item 80 (4) The bookmaker network reserves the right to declare a concluded betting agreement (including one concluded before or after the start of an event) invalid, to refuse to fulfill obligations under such an agreement (including to refuse to pay out any winnings) or to return any bet made, if:
- one Client has several gaming accounts (multiple registration, multi-accounting), including under a new name. The bookmaker network does not recommend two or more Clients to place bets from one IP address (one device, local network);
- one Client uses the data of other persons to register new gaming accounts, including members of his family;
- bets are made by a group of Clients acting in collusion with the aim of circumventing the restrictions established by the Bookmaker network;
- the client is suspected of using any software that allows for the automation of the betting process;
- the game account is used for playing in arbitrage situations;
- the gaming account is not used to place bets and other products offered by the bookmaker network;
- loyalty programs are being abused;
I have not violated any of the listed points of the Rules and the amount of this claim is significantly lower than the winnings limits set by the Parimatch bookmaker.
Obligations must be fulfilled by the parties properly in accordance with the terms of the obligation; unilateral refusal to fulfill an obligation is not permitted.
Let us move on to a further presentation of the controversial situation that has arisen.
3. When I learned that you can play responsibly and legally at Parimatch LLC, like many other players, I went to Google PlayMarket and downloaded the Parimatch Bonus app to my mobile phone. I registered on your website and have been actively playing for more than 2 months.
My account number ___________ on the Parimatch bookmaker website is verified and is actively used:

Numerous daily deposits add up to impressive amounts for me, but the motivation for playing is the company's legitimacy in the Ukrainian market and the huge turnover of the international Parimatch group as a bookmaker. Thus, I was sure that I would be able to get a big win and continued playing.
4. After 2 months of playing without much return in my favor, the long-awaited upstreak finally came. As a player with many years of experience, I always adhere to the position that if gambling "gives", you need to maximize the resulting plus and raise the stakes. The night from 06/11/2021 to 06/12/2021 was extremely successful for me. The extreme point of my balance was 06/12/2021 at 06:59 am (Kyiv time) - at a bet of 19,000 UAH, the Wild Wild Chest (Red Tiger) slot raised the balance to 10,266,400 UAH.

I took a screenshot of my mobile phone and exited the game. You can order an examination of the photos and phone to verify the veracity of my words - the photos were taken in the game, on the phone on 06/12/2021 at 06:59.
5. After I closed the game, I discovered that the balance had not been transferred to my game account. All operational negotiations with the support service, both in the chat and by phone, by e-mail, came to a dead end. Parimatch LLC stubbornly refused to acknowledge the fact of winning and credit it to my game account.
6. Before turning to the technical support answers, I ask you to focus on the following important points for the investigation:
6.1. The game was played from a mobile phone, so this completely cuts off the options for choosing the "Demo game" mode - as the main argument of your support service. The mobile version of the site does not provide the opportunity to choose the "Demo" mode, the game for mobile devices is always played only for real money.
6.2. For a bet of 19,000 UAH, a balance of 10,266,400 is equivalent to one bonus game with a payout coefficient of x540. There are enough examples on the Internet of how slots give out winning coefficients from x1,000 to x20,000 to the bet. At the same time, as we know, slots of international providers provide a pure RNG, without stock mathematics and dependence of results on the bet size.
Analyze streams of Russian and foreign bloggers. A player buys a bonus game for $200-500 and the slot gives him almost $1,000,000 - these are rare events, but they are completely consistent with the mathematics of slot machines from international providers.
6.3. In normal operation, this slot has a bet size limit of $400. It would seem unrealistic to place a bet of UAH 19,000. But there are enough video examples on the Internet where casino employees see a rapid growth in a player's balance and his high bets, raise his limits in the slot, hoping that over the long term he will quickly lose his money. I admit that my limits were expanded, but the slot turned this situation to my advantage and rapidly increased the balance beyond all expectations.
6.4. I, unfortunately, cannot verify the contradictory statement of your support service that the game was played in demo mode from my account on the site. For some reason, Parimatch does not provide the player with statistics of his bets.

Thus, the Parimatch player has no tools to independently control the movement of his funds. The support service refuses to provide a transaction statement and refers to the game provider.
6.5. An appeal from a private person to an international slot manufacturer is not practiced, this is well known. In any controversial situation, it is the casino that sends official requests to game providers and receives responses. The casino has an agreement with the provider, all the necessary contacts and powers.
6.6. In the audio recording of the first conversations with the Parimatch support service, we repeatedly hear the phrase - "We looked through the data and did not find any records of this win." Therefore, the company has transaction data (it cannot be otherwise) and the refusal of the support service to provide a statement is a deliberate concealment of facts.
If we assume malicious intent, that an attempt was made to deny me a large win, then it is quite possible that the records of the relevant gaming transactions were either falsified by a group of interested parties or completely deleted from the casino database. Now, indeed, the Parimatch casino can show nothing.
7. Taking into account all of the above, for the purpose of pre-trial proceedings and conducting a full and fair investigation into my matter, I ask:
a) Bring this claim to the attention of all authorized persons in your company.
b) Save a copy of all your databases for 06/12/2021, regarding my gaming activity.
c) Save all my correspondence with technical support, starting from 06/12/2021.
d) Make an official request to the Red Tiger provider to provide full logs of their game server with a transcript of HTTPS requests regarding my game in the Wild Wild Chest slot during the specified period of time.
e) Review the claim within 10 days from the date of receipt and notify of the results in writing – to the email address specified in my account on the Parimatch website.
d) All further discussions of this claim shall be conducted exclusively in writing. It is proposed to resolve the dispute out of court.
e) After the agreed period for consideration of the claim, if the parties do not come to a mutual agreement, my claim has the right to become public - with the involvement of the courts, the KRAIL, the ADR commission, SMM and the media.
8. I DEMAND:
Accrue and pay out the winnings in the amount of - according to my payment details
10'266'400 UAH.

If this claim is rejected, an appeal to the court will be made to protect my rights and, in addition to the above, a demand will be made to recover a penalty and moral damages for improper performance of my obligation.
